Copyright & DMCA Policy

Article I — DMCA Safe Harbor

As an online service provider hosting third-party content, the Company qualifies for safe harbor protection under the DMCA, provided it complies with the notice-and-takedown procedures set forth herein. The Company has designated a copyright agent and has implemented a repeat infringer policy as required by the DMCA.

Article II — Designated Copyright Agent

Article III — Submitting a DMCA Takedown Notice

If you believe that content on the Platform infringes your copyright, please submit a written notice containing all of the following:

1. A physical or electronic signature of the person authorized to act on behalf of the copyright owner
2. Identification of the copyrighted work claimed to have been infringed
3. Identification of the material on the Platform that is claimed to be infringing, with sufficient detail for us to locate it (e.g., URL, AI Agent name, listing page)
4. Your contact information: name, address, telephone number, and email address
5. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf

Incomplete notices may not receive a response. False or fraudulent notices may expose the submitter to liability under 17 U.S.C. § 512(f).

Article IV — Our Response to Valid Notices

Upon receipt of a complete and valid DMCA notice, the Company will:

• Promptly remove or disable access to the allegedly infringing content
• Notify the Contributor whose content was removed
• Provide the Contributor with a copy of the notice (with personal information redacted where appropriate)

Article V — Counter-Notification

If you are a Contributor and believe your content was removed as a result of a mistake or misidentification, you may submit a counter-notification containing:

1. Your physical or electronic signature
2. Identification of the content that was removed and its location before removal
3. A statement under penalty of perjury that you have a good faith belief the content was removed as a result of mistake or misidentification
4. Your name, address, and telephone number, and a statement that you consent to jurisdiction of the federal district court for the judicial district in which your address is located
5. A statement that you will accept service of process from the person who submitted the original DMCA notice

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed content at our discretion.

Article VI — Repeat Infringer Policy

In accordance with the DMCA and other applicable law, the Company has adopted a policy of terminating, in appropriate circumstances and at the Company's sole discretion, the accounts of users and Contributors who are deemed to be repeat infringers. The Company may also limit access to the Platform for any user who infringes the intellectual property rights of others.

Article VII — Trademark Infringement

This policy addresses copyright infringement. Claims of trademark infringement should also be submitted to legal@byfrosty.com with a description of the trademark, the basis for ownership, and identification of the infringing material on the Platform.
