Usage Policy — byFrosty

This Usage Policy ("AUP") governs your use of the byFrosty platform and marketplace at byfrosty.com, operated by VoicePunch LLC. This AUP is incorporated by reference into the byFrosty Terms of Service. Violation of this AUP may result in immediate suspension or termination of your account, removal of content, and/or referral to law enforcement where appropriate.

Article I — Prohibited Content

You may not upload, submit, distribute, or make available any AI Agent or content that:

1.1 Is Malicious or Harmful

Contains viruses, malware, spyware, ransomware, trojans, worms, or any other malicious code
Is designed to damage, disable, interfere with, or gain unauthorized access to any system, network, or data
Performs actions on a user's device without informed consent
Exfiltrates, harvests, or transmits user data without authorization

1.2 Is Illegal or Facilitates Illegal Activity

Violates any applicable federal, California, or local law or regulation
Facilitates fraud, identity theft, phishing, or financial crime
Enables unauthorized surveillance, stalking, or tracking of individuals
Facilitates the production, distribution, or possession of child sexual abuse material (CSAM) — zero tolerance; immediate termination and referral to law enforcement

1.3 Infringes Third-Party Rights

Infringes any copyright, trademark, patent, trade secret, or other intellectual property right
Violates any right of privacy or publicity
Misappropriates any third-party's proprietary information

1.4 Is Deceptive or Misleading

Misrepresents the functionality, capabilities, or purpose of an AI Agent
Impersonates any person, company, or AI system
Contains false or misleading metadata, descriptions, or documentation

1.5 Is Hateful or Abusive

Promotes or facilitates hatred, discrimination, or violence based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
Contains harassment, threats, or intimidation directed at any individual or group

Article II — Prohibited Platform Conduct

You may not use the Platform to:

Attempt to gain unauthorized access to any account, system, or network
Probe, scan, or test the vulnerability of the Platform or any related system
Interfere with or disrupt the integrity or performance of the Platform or its users
Circumvent any security, access control, or authentication mechanism
Scrape, crawl, or systematically extract data from the Platform without written consent
Use automated tools to create accounts, post content, or interact with the Platform
Sell, resell, or sublicense access to the Platform without authorization
Use the Platform for cryptocurrency mining or other unauthorized resource consumption

Article III — Contributor Responsibilities

If you submit AI Agents as a Contributor, you additionally agree to:

Test your AI Agent thoroughly before submission to ensure it functions as described
Accurately describe your AI Agent's capabilities, limitations, data usage, and any third-party dependencies
Maintain and update your AI Agent submissions to address security vulnerabilities or material bugs
Promptly notify the Company at legal@byfrosty.com if you discover your AI Agent has caused or may cause harm
Comply with all applicable AI-specific laws and regulations, including those governing automated decision-making, data processing, and consumer protection

Article IV — AI-Specific Restrictions

AI Agents submitted to or used through the Platform must not:

Generate, distribute, or facilitate the creation of CSAM or non-consensual intimate imagery
Be designed to manipulate, deceive, or psychologically exploit users, particularly vulnerable populations
Autonomously take irreversible real-world actions (financial transactions, legal actions, system modifications) without explicit user confirmation
Claim to be human when directly and sincerely asked
Be used to generate disinformation, deepfakes, or synthetic media intended to deceive
Violate any applicable AI governance framework, executive order, or regulatory guidance in effect at time of use

Article V — Enforcement

5.1 Reporting Violations. Report violations of this AUP to legal@byfrosty.com. Include a description of the violation, the AI Agent or content involved, and any supporting evidence.

5.2 Company Discretion. The Company reserves the right, but not the obligation, to investigate reported violations and to take any action it deems appropriate, including removing content, suspending or terminating accounts, and reporting conduct to law enforcement.

5.3 No Liability for Enforcement Actions. The Company shall not be liable to you or any third party for any action taken or not taken in connection with enforcement of this AUP.

Article VI — Updates

We may update this AUP from time to time. Updated versions will be posted at byfrosty.com/aup. Continued use of the Platform after updates take effect constitutes acceptance.
